⚖️ LEGAL NOTICE, LIABILITY WAIVER & TERMS OF USE

§1 — Nature of Service & No-Warranty Provision

This tool is provided strictly "as is" and "as available", without any warranty of any kind — express, implied, statutory, or otherwise — including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, or continuous availability. No oral or written statement by the operator shall create any warranty not expressly stated herein. Use of this tool constitutes full and unconditional acceptance of these terms.

§2 — Zero Data Access by Operator (Technical Impossibility)

All cryptographic operations — including key derivation, encryption, decryption, and integrity verification — are executed exclusively within the user's local browser environment via the native Web Cryptography API (crypto.subtle). The operator of araveli.com does not receive, transmit, process, store, log, or have any technical means of accessing the user's plaintext content, passwords, derived keys, initialization vectors, HMAC tags, or any intermediate cryptographic material, at any point in time, under any circumstances.

This is not a policy choice — it is a mathematical and architectural impossibility. Any claim alleging that the operator possesses or could recover user data is factually false and technically unsupportable.

§3 — Irrecoverability & User Responsibility

The user expressly acknowledges and accepts that:

  • Loss of the password or corruption of the encrypted data results in permanent and absolute irrecoverability of the original content, with no exception.
  • This is an inherent property of AES-256-GCM encryption and PBKDF2 key derivation — not a defect, malfunction, or failure of this tool.
  • The operator has no mechanism — technical, legal, or otherwise — to assist in recovery.
  • The user is solely and entirely responsible for maintaining secure, redundant backups of both the password and the encrypted data.
  • The operator shall not be held liable for any data loss arising from forgotten passwords, corrupted data, user error, hardware failure, or any other cause.

§4 — Comprehensive Limitation of Liability

To the maximum extent permitted by applicable law, the operator of araveli.com, its affiliates, agents, representatives, and successors shall not be liable — under any legal theory, including contract, tort, strict liability, negligence, or otherwise — for any of the following damages, whether direct, indirect, incidental, special, consequential, punitive, or exemplary:

  • Loss of data, content, digital assets, credentials, or access;
  • Loss of profits, revenue, business opportunity, or financial assets of any value;
  • Loss of cryptocurrency, private keys, seed phrases, or any blockchain-based asset;
  • Unauthorized access resulting from user-side failure (weak passwords, insecure environments);
  • Damages arising from use, misuse, inability to use, or reliance upon this tool;
  • Any claim related to the mathematical impossibility of decryption without the correct password.

In no event shall the operator's total aggregate liability exceed zero (USD $0.00), as no consideration is exchanged for the use of this free tool.

§5 — Governing Law & Jurisdiction

This tool is operated from Brazil. These terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted exclusively to the courts of Brazil. To the extent permitted by law, the user waives any right to bring claims in any other jurisdiction.

For users in the European Union: nothing in these terms limits rights that cannot be waived under mandatory EU consumer law; however, as this tool involves no data processing by the operator, GDPR obligations do not apply to the operator (the user is the sole data controller of their own local operations).

For users in the United States: this tool is not subject to U.S. jurisdiction. No implied warranties arise under the UCC or any state consumer protection statute, as no commercial transaction occurs.

For users in any other jurisdiction: the user is responsible for verifying that use of encryption software complies with local law. The operator makes no representations regarding legality of use in any specific jurisdiction.

§6 — Export Controls & Legal Compliance

The user is solely responsible for ensuring that their use of this tool complies with all applicable local, national, and international laws and regulations, including but not limited to export control laws, encryption regulations, and data protection statutes. The operator assumes no responsibility for user compliance with such laws.

§7 — No Professional Advice

Nothing in this tool or its documentation constitutes legal, financial, cybersecurity, or professional advice. The operator is not a licensed attorney, financial advisor, or certified security professional. Users encrypting high-value assets are strongly advised to consult qualified professionals independently.

§8 — Indemnification

By using this tool, the user agrees to indemnify, defend, and hold harmless the operator of araveli.com from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) the user's use or misuse of the tool; (b) the user's breach of these terms; (c) any third-party claim related to the user's encrypted content; or (d) loss of data due to forgotten credentials or user-side failure.

§9 — Severability & Entire Agreement

If any provision of these terms is found unenforceable under applicable law, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between the user and the operator regarding this tool and supersede all prior representations or understandings.

§10 — Acceptance

By encrypting or decrypting any content using this tool, the user irrevocably confirms that they have read, understood, and fully accepted all terms stated herein. If you do not agree, do not use this tool.
